Cambodian dissident: ‘Unlawful’ trial shouldn't proceed

A trial set to open tomorrow against 10 members of a Cambodian dissident group is “unlawful” and should be thrown out, the self-exiled leader has said in an appeal.
The 10 men are members of the Khmer National Liberation Front (KNLF), a dissident group that is considered a terrorist organization by Prime Minister Hun Sen.
They were arrested over a two-day period in October on accusations that they were plotting to incite violence by planting explosives along the border with Thailand, police said at the time.
However, KNLF leader Sam Serey reiterated in his statement, released Thursday, that they had been holding a peaceful demonstration in front of the Vietnamese Embassy.
The gathering had aimed at calling for respect for human rights on the 23rd anniversary of the signing of the Paris Peace Accords that ended civil war in Cambodia.
“Unfortunately, they have been unfairly imprisoned for nearly nine months,” he said, adding that their detention was “unlawful” and a violation of the constitution, which is supposed to guarantee the right to “participate actively in the political, economic, social and cultural life of the nation.”
He stressed that there is “no evidence to prove that they have committed violence.”
“Therefore, the court should consider their cases and drop a charge against them and release them without condition.”
The KNLF’s manifesto spells out its opposition to Hun Sen’s government, which it says is beholden to Vietnam.
In April 2014, 12 men and a woman were convicted — six of them in absentia -- for plotting to overthrow the government. Prison terms for those who were present ranged between five and nine years.
Serey is one of the 12, and likely would be in prison were he not in exile in Denmark, from where he runs the KNLF.
A month later, another member of the group was arrested for being in possession of a few hundred copies of the KNLF manifesto. He was also tried and imprisoned for allegedly plotting to commit an attack on Cambodia.
Phay Siphan, spokesperson for the government’s Council of Ministers, could not be reached for comment by Anadolu Agency on Monday.

Group Denied Bail Due To ‘Serious’ Charges

The Phnom Penh Municipal Court on Tuesday denied a bail request from eight members of the Khmer National Liberation Front (KNLF), a political advocacy group that opposes the ruling CPP, due to the serious nature of the charges against them.
The eight were arrested in October before a planned protest outside the Vietnamese Embassy and subsequently charged with plotting to overthrow the government and inciting violence.
Presiding Judge Chea Sok Hieng on Tuesday upheld a decision to keep the men in prison ahead of their trial later this month.
“Plotting is a serious crime…so the request by defendants’ lawyer, Choung Choungy, to deposit money for bail is rejected,” he announced to the court. The defendants reacted by shouting “injustice” as they were escorted from the courtroom.
“I did nothing wrong…I will not flee anywhere,” said Lat Liheng, 22. Mr. Choungy vowed to appeal the decision.

Dissident Says Group Drafting Plans for Government-in-Exile
Some 30 delegates approved a draft set of procedural rules for the CNCC and elected a number of people to leadership and administrative positions—mostly KNLF members, according to Mr. Serey, who said he hoped the government-in-exile would be formed next year.
“The government in exile will suggest to the signatories countries and the UN to take actions to ensure the full and final implementation of Paris Peace Agreement 1991 and seek the justice for Cambodians who have been killed since 1975 until the present,” he said via email.
Mr. Serey said the new congress elected New Zealand national and KNLF member Krech Siphan as its chairman.
The meeting comes as 23 alleged KNLF members, including Mr. Serey, have been either convicted or charged with planning to topple the government of Prime Minister Hun Sen.
Among the group, seven were imprisoned for five to seven years in April after being convicted of plotting to provide a foreign nation with the means to carry out hostile acts against the Cambodian government. Ten more are being held in provisional detention after being arrested in October.
Mr. Serey, who is among those convicted in absentia and lives in Denmark, insists the group is only working to peacefully spread the word about how the CPP government is controlled by Vietnam and destroying the country.
Council of Ministers spokesman Phay Siphan said Sunday that the CNCC—like the KNLF—would be treated by the Cambodian government as a terrorist organization.
“These people, we don’t consider them to be a government-in-exile. These people will be considered as part of a terrorist group,” he said.
“If we have enough evidence that they are related to an illegal organization, we will send them to court for that.”

Denmark based group to create a Cambodian exile government
The Khmer National Liberation Front (KNLF) with leader and headquarters located in Hundested, Denmark is planning to create an exile government as soon as possible.
The KNLF has announced that they and delegates representing Cambodian citizens from the home country and abroad are going to meet Friday the 12th December with the intention to discuss, agree and adopt a new constitution in order to establish a Cambodian government in exile, Phnom Penh Post reports.
The leader of KNLF Sam Serey is a refuge who lives in Denmark. Earlier in 2014 a Cambodian court found him guilty of treason and plans to overthrow the government for which he was sentenced to 9 years in prison. A trial the NGO Human Rights Watch called politically motivated and without foundation in reality.
Sam Serey claims to work peacefully on informing the world about the situation in Cambodia, and according to Danish newspaper Berlingske Tidende, Sam Serey has earlier been meeting with former Danish Foreign Minister Per Stig Møller and the Danish Ambassador to Thailand and Cambodia.

A group of Cambodian dissidents is planning to establish a government-in-exile to oppose what it claims is the country’s pro-Vietnam regime, local media reported Monday.
The Khmer National Liberation Front, known as the KNLF, announced it would be forming the Cambodian National Constitutional Congress to “discuss, agree and adopt a new constitution as the basis for establishing a Cambodian government-in-exile as soon as practicable.”
But Cambodia’s main opposition party, the Cambodia National Rescue Party, denied Monday having anything to do with the scheme.
In a telephone interview, spokesman Yim Sovann told The Anadolu Agency: “It is not relevant to the CNRP, it’s nothing to do with the CNRP. It is a false statement… It is irrelevant.”
In an emailed statement at the weekend, KNLF President Sam Serey, who lives in exile in Denmark, announced joining forces with the main opposition and other activist groups.
He said Cambodia was continuing to “suffer under communist dictator Hun Sen and the colonisation of Vietnam, with ongoing freedom and human rights violations, murder, imprisonment, forced evictions and land grabbing, and human trafficking.”
He said the new congress would be formally set up on Friday.
“Some of them are delegates outside the country and some delegates inside the country are involved,” Serey was quoted in the Phnom Penh Post.
The KNLF, established in 2012, considers Prime Minister Hun Sen’s government to be a puppet of Vietnam and describes it as a “neo-colony and dictatorship regime.”
Sen has branded the KNLF a terrorist organization. The Post quoted government spokesman Phay Siphan as saying that anyone violating the existing constitution would be “subject to the law.”
Ten alleged KNLF members are currently facing charges of treason, the Post reported.

Cambodia charges 10 men with conspiring treason: police spokesman
PHNOM PENH, Nov. 2 (Xinhua) -- A Cambodian court has charged 10 suspects, who were arrested here last week, with conspiring treason that could face up to ten years in prison if convicted, a National Police spokesman said Sunday.
The ten men were apprehended on Wednesday and Thursday last week in Phnom Penh with evidence to prove that they were members of the Khmer National Liberation Front (KNLF), an anti-government movement, National Police spokesman Lt. Gen. Kirt Chantharith said at a press conference.
"Our authorities seized KNLF's 770 flags and 461 anti- government pamphlets from those suspects during the raids," he said. "Moreover, those suspects have assignment letters from the KNLF."
Chantharith said the Phnom Penh Municipal Court has charged them with conspiring treason, which is a crime that could lead to imprisonment between five and ten years under the country's criminal code.
He said the Denmark-based KNLF was founded in December, 2012 by fugitive Sam Serei and his accomplices.
"The group has a plot to overthrow the legitimate Cambodian government through forming illegal armed forces, sending spies to key military locations, distributing anti-government leaflets, and training illegal armed forces along Thai border," he said.
In April, a Cambodian court convicted 13 KNLF men of treason for forming illegal armed forces and sentenced them between five and nine years in prison. Only seven of the convicts have been serving their jail terms since the others had fled the country.

The statement of Mr.Sam Serey President of Khmer National Liberation Front
The Khmer National Liberation Front headquarters is located in Denmark. Its official operation in national and international history starts effectively on December 12th 2012.
The Khmer National Liberation Front is abbreviated as letter K.N.L.F. Its logo has yellow circle with JayavaramannVII pictured sitting in meditation with a green leaf as background and with the name “Jayavaramann VII” below. Blue rice stalks surround the circle with the abbreviation K.N.L.F below.
The Khmer National Liberation Front is made up of real Khmer nationalists and Khmer democrats who work and cooperate with the democratic countries, internationally and with United Nations in its mission to fight for peace, freedom and democracy. Its aim is to seek justice for, free the Cambodian people from the Vietnamese neo-colony and dictatorship regime under Hun Sen. It is based on international laws, the Paris Peace Agreement and the rights of the Cambodian people.
-To unite all Cambodian people, those in Cambodia itself as well as throughout the world, who desire real peace, freedom and democracy.
-To prosecute and condemn criminals, the Cambodian People Party and the dictator Hun Sen who have committed crimes against humanity in Cambodia; for causing deaths of the Khmer people in plan K5, forced evictions and land grabbing, and for causing the deaths of the Khmer people on the Koh Pich Bridge and elsewhere. We wish to continue to seek out the criminals or countries responsible for the Khmer genocide during the Kampuchea Democratic regime, bring them to trial at the international court.
-To prosecute and condemn criminals in the present government, Cambodian People Party led by the dictator Hun Sen which has violated the Paris Peace Agreement and human rights.
-To prosecute and condemn Vietnam which violates the Paris Peace Agreement and Cambodia.
The Khmer National Liberation Front does not recognize the present government led by the Cambodian People’s Party and the dictator Hun Sen for the following reasons:
The Cambodian People’s Party is a branch of the Indochinese Communist Party, which was responsible for the criminal killing of Cambodian people during Kampuchea Democratic Regime (Khmer Rouge).
The government led by the Cambodian People’s Party and the dictator Hun Sen was installed by Vietnam and caused the deaths of Cambodian people in the plan known as K5.
The Cambodian People’s Party, led by dictator Hun Sen took power on July 5th -6th 1997 after a bloody coup. They have continued to violate human rights and cause the deaths of Cambodians until the present time.
The Khmer National Liberation Front demands that the internationals community does not recognize the present government led by the Cambodian People’s Party and the dictator Hun Sen.
The Khmer National Liberation Front demands that Vietnamese troops and agents wearing civilian attire to infiltrate into the Cambodian People Party withdraw from Cambodia. We further demand that the United Nations send a United Nation’s Security Keeping Force to Cambodia to set up temporary government to ensure that the Paris Peace Agreement is implemented fully and effectively in Cambodia.
The Khmer National Liberation Front has obligations and duties to implement this declaration, which must be enacted with full force and effectiveness until its goals are achieved.

President Sam Serey has played his activities for fighting for peace, freedom, democracy and seeking justice for Cambodian. He has been strongly committed with his endeavor to help his people and his country for real peace, freedom and democracy from Vietnamese Neo-colony and dictatorship regime Hun Sen. He was a former director of International Institute for Development Human Resource in Cambodia. He made a seminar and lecture at the braches of Wan Lan University and his institutes throughout Cambodia. He has written three books which published in Thailand and distributed to Cambodia. All these books have been banned in Cambodia by the dictatorship government of Hun Sen. He helped trained the political leadership, political view, politics and democracy to Cambodians. The students are monks and Cambodian in Thailand. The government is not happy with him and wanted to arrest him in Cambodia. Fortunately, he escaped to Thailand from the dictatorship government Hun Sen and protected by the UNHCR in Thailand. He and his families received his political asylum in Denmark. When he settled in Denmark in 2010, he still continued to fight for freedom and democracy for Cambodians.He had a meeting with member of Danish parliament Mr. Michael Austrup Jensen on April 19th 2012for discussion about the human rights violation in Cambodia, which was committed by dictatorship government and his master Vietnam. He has been also meeting with Danish ambassador Michael Hemniti Winther in Bangkok, Thailand August 20th 2012, for telling him about the situation in Cambodia. He also met with Mr.Bradley Cox who is the film maker who killed Chea Vichea. Sam Serey used to be a translator for Mr.Bradley Cox when he lived in Thailand. Now Mr. Sam Serey is a President of Khmer National Liberation Front which located in Denmark from December 12th 2012.
